3. C7S INTELLECTUAL RIGHTS FAQ
The aim of the intellectual rights policies of the C7S is threefold:
1. To encourage the wide spread dissemination of C7S product and services.
2. To preserve the integrity and Intellectual Property Rights (IPR) of C7S and C7 licensed for use by C7S.
This document answers several Frequently Asked Questions (FAQ) about C7S work.
1. Which statements apply to specifications, Web pages, and software?
IPR Notice
General web site copyright, trademark, and legal disclaimer statements. Copyright in any application, document and web site created shall be deemed to have been created under the terms of the Copyright, Designs and Patents Act 1988 (United Kingdom) and shall be vested in Cluster Seven Limited as Producer within the meaning of the Act. The copyright thus published on the C7S website does not imply any change of ownership in the copyright vested in C7S and any contributors to the web site.
Document Notice/License
Information on C7S documentation including copyright and distribution rights.
3.2. Who holds the copyright on C7S documents?
The original author of the document. Many documents are created by the C7 and licensed for use by C7S and we consequently hold the right to use copyright within the trems of license and UK law. Owners who allow their works to be published on the C7S site retain the copyright, but agree to C7S redistributing those materials from our site.
3.2.1 What about the trademarks?
The trademarks, logos, service marks, brand identities, title, characters, trade names, graphics, designs, copyrights and other properties appearing within C7S’s web sites (collectively the "Trademarks") displayed on C7S's web sites are protected intellectual properties that are registered and unregistered trademarks of Cluster Seven Limited, its affiliates and others. Nothing contained on C7S’s web sites should be construed as granting, by implication, or otherwise, any license or right to use any Trademark displayed on this website without the written permission of C7S or such third party that may own the Trademark displayed on C7S's web sites. Your misuse of the Trademarks displayed on C7S's web sites, or any other content on C7S's web sites, except as provided herein, is strictly prohibited.
3.3. What is the STATUS of a C7S document?
The STATUS of a C7S document is very important. It details its purpose, how the document was created or received, whether we are allocating resources to an activity related to the document, whether we have editorial control over the document, and how it may be referenced by other activities or documents. Not all docements are marked with a status. We disapprove and will act upon the misrepresentation of our work with respect to authorship, endorsement, or status.
3.4. May I link to the C7S site?
Of course. Links are merely references to other sites. You don't have to ask permission to link to this site — or any other website.
However, you should never do anything (including making a link) that misrepresents what is being linked to, or implies a relationship with the C7S that does not exist. For instance, you may not use misleading frames, URL tricks, or redirections that misrepresent C7S content as being published by anyone other than C7S. Note, this requirement to be clear in your representations is your obligation, the C7S does not sign waivers about who may link to us.
3.5. C7S Documents
C7S documents can be redistributed or republished on the condition that you provide information so that others can easily find the original document, that you provide notice of the C7S's copyright, and that if the document has a "STATUS" section, you reproduce it.
3.5.1 I am a teacher, can I print out specifications and other documents for my class to read?
Yes. Fortunately most programs include the source URL when printing a document. You should also inform the class of the document's copyright notice.
3.5.2 I have a Web site that mirrors (has copies of) useful Web documents, can I make copies of your documents and serve them from my site?
Yes, provided that you clearly represent the status of the document and that the canonical version of the document can only be found on the C7S site. You should feel free to reference this FAQ or our other legal notices to make this representation clear.
3.5.2.1 Can I mirror the C7S site?
Yes but only if agreed in advance, in writing, with C7S.
3.5.3 I am a writer and would like to make a "fair use" excerpt from a specification for my analysis, what do I have to do?
If you believe your usage falls within the exception of fair use (e.g., in the U.S. § 107 Title 17. Limitations on exclusive rights: Fair use) we ask that your citation or reference to the excerpted material include the document's title, editors/authors, publication date, C7S and document URL, an indication of its maturity/status (e.g., Working Draft, Recommendation, Note, etc.) and reference to C7S’s trademark and copyright notice.
3.5.4 I am a publisher and would like to publish a book that includes some of your specifications, what should I do?
You must include a link or URL to the original C7S document, its status and its copyright notice. Conveniently, by including the complete specification you include much of this information since it is an integral part of the C7S document. In addition to the document and its STATUS information, URL, and copyright notice, we ask that you provide the full text of our document copyright. You may not alter the content of the document (though we do sometimes grant permission to reformat or translate where we are contacted with reasonable notice by email or post) in any way, including the integration of errata.
3.5.5 Can I translate one of your specifications into another language?
Yes, you may translate a C7S Technical Report and white paper provided that you comply with the all of the following requirements:
1. Inform the C7S of your plan to translate our content and inform us of when you've completed and published the translation. Such notice should be sent in English to enquiries@clusterseven.com and — if provided — the comments email list associated with that document.
2. Prominently disclose in the target language the following 3 items:
1. the original URL, the status of the document, and its original copyright notice.
2. that the normative version of the specification is the English version found at the C7S site.
3. that the translated document may contain errors from the translation.
This disclosure should be made in a header and/or footer that wraps the translated C7S specification. No semantic changes should be made to any part of the C7S document including the STATUS, contributors, or appendices. If comments or annotations are absolutely necessary within the content of the specification, those annotations must be clearly represented as such.
3. Agree:
1. to the redistribution terms of the C7S document copyright notice. Consequently, your translation may be republished by the C7S or other entities if it is done in compliance with the notice's terms.
2. that the C7S may rescind your right to publish or distribute the derivative work if the C7S finds that it leads to confusion regarding the original document's status or integrity.
If you wish to translate a document other than a Technical Report or White Paper you must ask for specific permission as these documents are likely to change often, send you request to the document author/editor and enquiries@clusterseven.com.
3.5.7 Can I create the "official" translation?
No, the only official version of a C7S document is the English language version at the C7S site.
3.5.8 Can I annotate one of your specifications?
There are two types of annotations mechanisms: (1) those that do not require the copying and modification of the document being annotated (e.g., an external service stores annotations that identify their target via XPointer) and (2) those that are created by copying and modifying the document itself (e.g., the file is copied and modified and the annotations are included in-line but differentiated using CSS). Annotations of the first type are links to the C7S site, which is permitted as long as those links do not misrepresent the document, its status, and relation to the C7S.
Annotations of the second (including the reorganization and excerption of copyrighted material) are derivative works and are not permitted except as below. You may make a copy of a Technical Report and/or White Paper and annotate it only if you comply with the following requirements:
1. Inform the C7S of your plan to annotate our content and inform us of when you've completed and published the annotation. Such notice should be sent in English to enquiries@clusterseven.com and — if provided — the comments email list associated with that document.
2. Prominently disclose that the resulting display or document is an annotation and the C7S is not responsible for any content not found at the original URL and that any annotations are non-normative.
3. This disclosure should be made in a header and/or footer that wraps the annotated C7S specification. No semantic changes should be made to any part of the C7S document including the STATUS, contributors, or appendices. If comments or annotations are absolutely necessary within the content of the specification, those annotations must be clearly represented as such.
4. Agree: that the C7S may rescind your right to publish or distribute the derivative work if the C7S finds that it leads to confusion regarding the original document's status or integrity.
3.5.9 May I publish your specification in a different format (e.g., PDF)?
The creation of a reformatted work is a derivative work, something we do not generically permit. However (like translations) we do want our Technical Reports and White Papers to be as widely available as possible, though we must ensure that readers of derivative works understand the status of the derived work, its relation to the C7S, and how to get the original.
We grant specific permission to reformat a document if the requester complies with the all of the following requirements:
1. Inform the C7S of your plan to reformat our content and inform us of when you've completed and published it. Such notice should be sent in English to enquiries@clusterseven.com and — if provided — the comments email list associated with that document.
2. No semantic changes should be made to any part of the C7S document including the STATUS, contributors, or appendices.
3. If you provide any information or context about the reformatted version you must prominently disclose the following 3 items:
1. the original URL, the status of the document, and its original copyright notice.
2. that the normative version of the specification is the original version found at the C7S site.
3. that the reformatted document may contain formatting or hyper-textual errors.
4. Agree:
1. to the redistribution terms of the C7S document copyright notice. Consequently, your version may be republished by the C7S or other entities if it is done in compliance with the notice's terms.
2. that the C7S may rescind your right to publish or distribute the derivative work if the C7S finds that it leads to confusion regarding the original document's status or integrity.
3.5.10 Are schema or document definitions covered by the document or software terms?
Check the actual schema or document for a specific license.
Otherwise, while schemas are frequently part of our specifications and seemingly fall under the a documents copyright terms, you may use them under the C7S Software License.
3.6. C7S Software
C7S software cannot be copied, modified and redistributed in any way whatsoever. Please review any notices or disclosures that accompany the software itself. Documentation of the software is also under the C7S software license, copies of which are available on request and at the sole discretion of C7S.
3.6.1 I am a software publisher and would like to release C7S software on a CD-ROM I am creating, may I? May I charge for it?
You may not reproduce and sell C7S software in any event whatsover without the writtent approval of C7S in advance.
3.6.2 I really like your software product, but would like to modify it, can I make the changes and re-release it?
No. Any modifications and re-relase will be deeme to be an infringement of copyright and where applicable patent with the resulting legal consequences for you.
3.6.3 What are the terms and conditions for purchase and use of XiGence, etc.?
Please contact C7S directly for a copy of our license and standard terms and conditions.
3.6.4 Is code released under the C7S license compatible with the GNU General Public License (GPL)?
No.
4. LEGAL JURISDICTION
In all matters the laws and jurisdiction of England shall apply.
